Gold Avocado is a marketplace platform operated by Amira Nassan, Kippenbergstraße 26, 04317 Leipzig, Germany (info@gold-avocado.com), that connects buyers and sellers. By using our platform, you agree to these terms.

1. Marketplace Platform

Gold Avocado is a marketplace platform that facilitates connections between buyers and sellers. We are not a party to transactions between users unless explicitly stated. We do not personally create, own, or guarantee every seller's product or service.

2. Unified Account

Buyers and sellers use the same unified account. You can both purchase offers and create your own offers with a single account.

3. Seller Responsibility for Descriptions

Sellers are responsible for accurate offer descriptions. The description, previews, and product details must truthfully represent what the buyer will receive.

4. Seller Responsibility for Digital Content Rights

Sellers confirm they have the right to sell or distribute the digital content they offer. Selling content without proper rights is prohibited.

5. Prohibited Offers

Fraudulent, misleading, or illegal offers are prohibited. Sellers must not create offers for prohibited products or services, including illegal services, adult content, weapons, or counterfeit goods.

6. Fund Holding (Escrow-Like Protection)

When a buyer makes a payment, the funds are temporarily held by the platform to protect both parties. Gold Avocado is not a bank and does not provide banking or financial services. Funds are held solely to ensure that the buyer receives what they paid for and that the seller is paid for their work. Funds are released to the seller only after the buyer accepts the delivery or the review period expires. If a dispute is opened, funds remain held until the dispute is resolved.

7. Stripe Payment Processing

All payments on Gold Avocado are processed by Stripe, a licensed and regulated payment provider. Gold Avocado does not store raw card details. Payment processing, fund holding, and seller payouts are handled through Stripe and Stripe Connect. By using the platform, you acknowledge that Stripe's terms of service also apply to your payment transactions.

8. Buyer Review Period

After delivery, the buyer has a review period to assess whether the order meets the offer description. For digital products, the review period is typically 24 hours. For services, the review period may vary and is shown during checkout. During this period, the buyer can accept the delivery, request a revision, or open a dispute. If the review period expires without action, the order is automatically completed and funds are released to the seller.

9. Payout Timing

Sellers receive their payout only after the buyer accepts the delivery or the review period expires. Payouts are not instant. Funds are first released to the seller's platform balance, and the seller can then withdraw to their connected Stripe account. Sellers must have a verified Stripe Connect account to receive payouts. Payout timing depends on Stripe's processing schedule.

10. Refund Policy

Refunds are not automatic. If a buyer is not satisfied with the delivery, they can open a dispute. Refund requests are reviewed individually based on the order details, delivery evidence, and applicable policy. Approved refunds are processed through Stripe back to the buyer's original payment method. Our full Refund Policy is available separately and forms part of these terms.

11. Partial Refund Policy

In some cases, a partial refund may be issued if the delivery was partially completed or partially as described. Partial refunds reduce the amount released to the seller proportionally. The platform determines partial refund amounts based on the evidence provided during dispute review.

12. Dispute Handling

If a dispute is opened, funds remain held until the dispute is resolved. Gold Avocado reviews each dispute individually, considering order details, delivery evidence, messages between parties, and applicable policies. Possible outcomes include full refund, partial refund, seller payout, or dispute rejection. Both parties are notified of the outcome. Dispute decisions are made in good faith to achieve a fair resolution.

13. Seller Obligations

Sellers are obligated to deliver what was described in their offer, within the agreed delivery time, and to respond to buyer messages and revision requests in a timely manner. Sellers must not request off-platform payment, attempt to circumvent the platform's fund holding or dispute system, or deliver work that does not match the offer description.

14. Buyer Obligations

Buyers are obligated to provide accurate requirements, review deliveries in good faith, and not open disputes without valid reasons. Buyers must not attempt to receive a refund after accepting and using a legitimate delivery. Abuse of the dispute system may result in account restrictions.

15. Platform Authority

Gold Avocado reserves the right to make final decisions on disputes, account restrictions, content removal, and policy enforcement. The platform may pause fund releases, reverse transactions, or suspend accounts in cases of suspected fraud, violation of these terms, or applicable law.

16. Fraud Prevention

Gold Avocado actively monitors for fraudulent activity, including fake accounts, stolen payment methods, collusive disputes, and attempts to circumvent platform fees. Suspected fraud may result in immediate account suspension, fund holds, and reporting to relevant authorities. We cooperate with law enforcement and payment providers in fraud investigations.

17. Abuse Prevention

Abuse of the platform — including but not limited to spamming, harassment, off-platform payment requests, false disputes, review manipulation, or repeated terms violations — may result in account warnings, restrictions, or permanent suspension. We monitor patterns of behavior to protect the community.

18. Chargebacks

If a buyer initiates a chargeback through their bank or card issuer, Gold Avocado may treat this as a dispute and hold or reverse the seller's payout. Sellers may be asked to provide evidence to contest the chargeback. Chargebacks initiated in bad faith may result in account restrictions.

19. Late Delivery

If a seller does not deliver within the agreed timeframe, the buyer may request a cancellation and refund. Repeated late deliveries may negatively affect a seller's account standing. The platform tracks delivery timeliness as part of seller performance metrics.

20. Digital Products

Digital products may become accessible immediately after a confirmed purchase. Access and download terms are shown on each product page. Buyers should review descriptions and previews before purchasing. Digital content that has been downloaded or accessed may be subject to withdrawal limitations under applicable law.

21. Services

Service offers involve work completed by a person within an agreed delivery time. Service terms, including delivery time and revisions, are shown during checkout. The buyer submits requirements, the seller delivers, and the buyer reviews the delivery during the review period.

22. Manual Delivery

For services and some digital products, delivery is performed manually by the seller. The seller submits the delivery through the platform, and the buyer reviews it. Funds are held until the buyer accepts or the review period expires.

23. Automatic Delivery

For some digital products, access may be granted automatically upon confirmed payment. Even with automatic delivery, the buyer still has a review period. The platform records access and download events for dispute and refund review purposes.

24. Platform Fees

Platform fees may apply to transactions. Fee details are shown where applicable before a purchase or payout is completed. Fees are deducted from the seller's earnings before payout.

25. Reports and Moderation

Users can report inappropriate content or behavior. Gold Avocado may review reports and take action, including content removal or account restriction.

26. Account Restriction or Suspension

Gold Avocado may restrict or suspend accounts that violate these terms or applicable policies. Sellers are not independently professionally certified by Gold Avocado.

27. Intellectual Property Complaints

Intellectual property complaints can be submitted through the report function. We respond to valid takedown requests in accordance with applicable law.

28. Statutory Consumer Rights

These terms do not affect your statutory consumer rights under applicable law. If a product is defective or not as described, your statutory rights remain unaffected.

29. Jurisdiction

These terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Leipzig, Germany, unless otherwise required by mandatory consumer protection law.

30. Changes to Terms

We may update these terms from time to time. Continued use of the platform constitutes acceptance of updated terms.
